AGENCY LEVEL

The process of applying for disability benefits involves four main stages. Roughly 60% of claims are denied in the initial stage. However, chances improve with an appeal. After a denial, you can file for Reconsideration, followed by a hearing with an Administrative Law Judge if needed. Further denial leads to review by the Appeals Council. Each stage has critical deadlines, and understanding your legal rights is essential. We're here to guide you through each step and help you make informed decisions.
APPEALING UNFAVORABLE ADMINISTRATIVE LAW JUDGE DECISIONS
The majority of Social Security Disability claims are denied by ALJs. If your application for benefits has been denied by the ALJ, you should not allow yourself to feel discouraged or decide to give up pursuing your SSD benefits. The next step in the process is filing an appeal with the Appeals Council. While this often leads to another denial, it’s a necessary step before you can go to federal court review.
REPRESENTATION BEFORE THE SSA’S APPEALS COUNCIL
After being denied disability benefits by an Administrative Law Judge, the next step is to appeal to the Social Security Administration's Appeals Council. This appeal must be filed within 65 days of the ALJ's decision. If the Appeals Council appeal is unsuccessful, the final option is to file an appeal in federal district court within another 65 days. Having an attorney can be helpful during these steps. Federal court provides an unbiased platform for reviewing ALJ rulings.
