How ARAG Supports Avoiding or Simplifying Probate in Florida

It can also help with proactive estate planning to reduce or even avoid probate entirely — saving your family significant time, money, and stress.

The state offers several powerful, state-specific tools that can help families avoid or simplify the probate process under Fla. Statutes Chapters 732–736:​​

 

  • Properly funded revocable living trusts — One of the most comprehensive ways to keep assets out of probate while maintaining full control during your lifetime.

  • Beneficiary designations (POD/TOD) on bank accounts, investment accounts, and retirement plans — allowing assets to transfer directly to named beneficiaries.

  • Joint ownership with right of survivorship — for certain assets (used carefully to avoid unintended risks).

  • Lady Bird Deeds (Enhanced Life Estate Deeds) — A popular state tool specifically designed for homestead and other real estate. This deed lets you retain full ownership and control of your home during your lifetime (including the right to sell, mortgage, or revoke it), while automatically transferring the property to your chosen beneficiaries upon your death — without going through probate. It also helps preserve valuable homestead protections and tax benefits.

These strategies can help many families qualify for Summary Administration (a simplified, faster probate process) or even Disposition Without Administration for smaller estates.

ARAG also provides general resources and attorney guidance on streamlining probate for small estates, helping you determine the most efficient path for your situation.

As of July 1, 2026, the threshold for Summary Administration has increased to $150,000 for non-exempt probate assets (or when the decedent has been deceased for more than two years).
