ARAG Legal Insurance Coverage for Florida Probate

We Understand the Added Financial Stress of Probate

Losing a loved one is already overwhelming. When you are named Personal Representative (the official term for an executor), are a surviving spouse, or when you are helping settle an estate—including guiding beneficiaries through their rights and inheritance process—the last thing you want is the added burden of high legal fees on top of court filings, appraisals, creditor notices, and tight deadlines.

If you have ARAG legal insurance (often available as an employee benefit), you may qualify for significant coverage that can reduce or eliminate your out-of-pocket attorney costs for many probate-related tasks.

At Tower Law Group, we proudly serve as a network attorney for members across Orlando, Oviedo, and the 67 counties statewide. We know how to maximize your benefits as your network attorney while guiding you through the probate process, which is governed by Florida probate rules and court procedures.

If you have ARAG legal insurance, you may already have coverage for probate services.

How ARAG Typically Helps with Florida Probate

Many plans offer paid-in-full coverage through network attorneys for key estate matters. A network attorney can help you apply these benefits to your specific probate matter under Florida law. Benefits that directly apply to probate include:

  • Estate Administration & Estate Closing (under Formal Administration): Up to 9 hours of paid-in-full legal services, including tasks required under Fla. Stat. Chapter 733 when you, as the insured, have been named Personal Representative. This can assist with:

  • Preparing and filing the probate petition

  • Inventorying and appraising estate assets

  • Notifying heirs and creditors

  • Paying valid debts and taxes

  • Final distribution of assets

  • Personal Representative Appointment: Paid-in-full assistance if you need to seek court appointment as the estate's representative.

  • Protection of Inheritance Rights: Limited hours to help assert or defend your right to inherit from an estate.

  • Document Review: Low-cost review of wills, trusts, or powers of attorney where you are named as an agent or representative.

Many plans also offer reduced-fee services (typically 25% off the attorney’s normal hourly rate) for additional hours or more complex matters.

IMPORTANT NOTE: ARAG supports the living insured (you) in your role as Personal Representative or family member. Coverage is subject to your specific plan, limitations, exclusions, and regulations. The examples above reflect typical plan structures and are not a guarantee of coverage for all members. Always verify your exact benefits directly with them.

Probate can be financially overwhelming, but your plan may help.

How ARAG Supports Avoiding or Simplifying Probate in Florida

It can also help with proactive estate planning to reduce or even avoid probate entirely — saving your family significant time, money, and stress.

Through your legal insurance plan, you can often access paid-in-full or significantly reduced-fee services for the preparation or review of key estate planning documents, including:

  • Last wills and testaments

  • Durable powers of attorney

  • Living wills (advance directives)

  • Revocable living trusts

Network attorneys can guide you on properly funding your revocable living trust so that assets pass directly to beneficiaries without court involvement.

The state offers several powerful, state-specific tools that can help families avoid or simplify the probate process under Fla. Statutes Chapters 732–736:

  • Properly funded revocable living trusts — One of the most comprehensive ways to keep assets out of probate while maintaining full control during your lifetime.

  • Beneficiary designations (POD/TOD) on bank accounts, investment accounts, and retirement plans — allowing assets to transfer directly to named beneficiaries.

  • Joint ownership with right of survivorship — for certain assets (used carefully to avoid unintended risks).

  • Lady Bird Deeds (Enhanced Life Estate Deeds) — A popular state tool specifically designed for homestead and other real estate. This deed lets you retain full ownership and control of your home during your lifetime (including the right to sell, mortgage, or revoke it), while automatically transferring the property to your chosen beneficiaries upon your death — without going through probate. It also helps preserve valuable homestead protections and tax benefits.

These strategies can help many families qualify for Summary Administration (a simplified, faster probate process) or even Disposition Without Administration for smaller estates.

NOTE: As of July 1, 2026, the threshold for Summary Administration has increased to $150,000 for non-exempt probate assets (or when the decedent has been deceased for more than two years).

ARAG also provides general resources and attorney guidance on streamlining probate for small estates, helping you determine the most efficient path for your situation.
